Terms of Use
Last updated: 26 October 2026
1. Who we are
Hypersay ("Hypersay", "we", "us") is operated by B-Side Tech Limited, a company registered in England and Wales (company number 15995448), registered office 1004 Lock Apartments, 21 Gillender Street, London, E3 3YH, United Kingdom. Hypersay was created by Learn Forward Ltd, which has passed the service to B-Side Tech Limited.
For any notice or question about these Terms, write to hello@hypersay.com.
2. Your agreement with us
Your use of the Hypersay websites (hypersay.com, app.hypersay.com, slides.hypersay.com and live.hypersay.com) and of the Hypersay products and services provided through them (together, the "Service") is governed by these Terms of Use and our Privacy Policy (together, the "Terms").
The Terms apply to all users of the Service, including users who contribute Content. "Content" includes presentations, text, graphics, photos, videos, interactive features, questions, answers and any other material you can view on, access through or contribute to the Service.
3. Accepting the Terms
You accept the Terms by using the Service. You may not use the Service if you do not accept them.
You must be at least 16 years old to use the Service. You may not use it if you are barred from receiving it under the laws of the country you live in or use it from.
4. Changes to the Terms
We may change the Terms from time to time, for example to follow changes in the law or in the Service. The current version is always at hypersay.com/terms. We will tell account holders about material changes by e-mail or in the Service. If you do not agree to the changed Terms, you must stop using the Service; using it after the change means you accept them.
5. Accounts
Some features need a Hypersay account. You must give accurate information when creating it and keep your sign-in details secure. Tell us straight away if you notice any unauthorised use of your account. You are responsible for all activity under your account.
6. Presenters and participants
- Presenters upload documents, add interactive content and run live sessions.
- Participants join a live session, with an account or anonymously when the presenter allows it.
What participants submit in a session (answers, questions, chat messages, feedback) is shared with the presenter and, depending on the session's settings, with other participants, as the Privacy Policy describes. A presenter who shares a session's results outside Hypersay is responsible for doing so lawfully.
7. Plans and payments
Hypersay has a free plan and paid options. The current plans, limits and prices are on the pricing page or are agreed with you directly.
- Payments are processed by Stripe. We do not store your card details.
- Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time; the subscription then ends at the end of the period already paid for.
- Session credits are used up when you run a session with them, and are not refundable once used.
- Prices may change. A change to a subscription's price applies from its next billing period, and we will tell you before it does.
- Nothing in these Terms affects your statutory rights as a consumer.
8. Acceptable use
You may use the Service for its intended purpose, including uploading your own presentations and presenting them in live sessions to promote a business or other enterprise. You agree not to:
- distribute, alter or modify any part of the Service, except through the features it offers;
- access Content by any means other than the Service itself;
- circumvent or interfere with the Service's security features or its usage limits;
- sell access to the Service, or sell advertising placed in it, without our written permission;
- use automated systems that send more requests than a person using an ordinary browser reasonably could;
- collect or harvest personal data of other users;
- use the Service to send unsolicited commercial messages to its users;
- upload Content that is unlawful, infringes anyone's rights, or contains pornography or hate speech.
We may suspend or end access for users who break these rules. We end access for repeat infringers of copyright, meaning users notified of infringing activity more than twice.
9. Your content
You keep all ownership rights in your Content. You are responsible for it, and you confirm that you have all the rights and permissions needed to upload it and to let us use it as described here.
So that we can run the Service, you grant:
- to us, a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, convert, display and transmit your Content as needed to provide the Service to you and to the people you share it with;
- to each user you share your Content with (for example the participants of your session), a licence to view and interact with it through the Service.
These licences end when you delete the Content or it is deleted under our retention rules, except for answers, questions and comments submitted in other people's sessions, which remain part of those sessions' records.
We do not claim your Content and do not use it to advertise the Service without your permission. We may remove Content that breaks these Terms, or when the law requires it.
10. Data retention
To keep the Service sustainable, presentations, uploaded documents and accounts that have not been used for two years are deleted, with everything they hold. Accounts with an active subscription are kept. The Privacy Policy has the details.
11. Our content
Apart from your Content, all content on the Service is owned by or licensed to us and protected by intellectual property rights. You may not copy or exploit it beyond the normal use of the Service without our written permission.
12. Links to other websites
The Service may link to websites we do not control. We are not responsible for their content, availability or privacy practices.
13. Changes to the Service and ending the agreement
We may change the Service, or stop providing it or any part of it, and will give reasonable notice where we can. If we stop providing a paid service you have already paid for, we will refund the unused part.
You may end the agreement at any time by deleting your account or asking us to.
We may end it if you seriously or repeatedly break the Terms, or if we are required to by law.
14. Warranties
The Service is provided "as is". We do not promise that it will meet your requirements, be uninterrupted, timely, secure or free from errors, or that information obtained through it will be accurate. This does not affect your statutory rights as a consumer.
15. Limitation of liability
Nothing in these Terms excludes or limits our liability where the law does not allow it, including for death or personal injury caused by negligence, or for fraud.
Subject to that, we are not liable for indirect or consequential losses, loss of profit, goodwill, opportunity or data, or losses caused by your failure to keep your account secure. Our total liability to you in connection with the Service is limited to the amount you paid us in the 12 months before the claim arose.
16. General
These Terms are the whole agreement between you and us about the Service and replace any earlier agreements about it, except for terms we agree with you in writing. If a court finds any part of them invalid, the rest remains in force. If we do not enforce a right, we have not waived it.
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK or in the EU, you may also bring proceedings where you live.
